OVERVIEW
Welcome to Everlamps. The terms “we,” “us,” and “our” refer to Everlamps Inc. Everlamps Inc operates this store and website, including the information, content, features, tools, products, and services offered through it (the “Services”). Everlamps is powered by Shopify, which enables us to provide the Services.
By accessing or using the Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you should not use the Services.

SECTION 1 - ACCESS AND ACCOUNT
You represent that you are at least the age of majority in your jurisdiction of residence or have permission from a parent or legal guardian to use the Services.
You agree to provide accurate, current, and complete account, billing, payment, shipping, and contact information.
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

SECTION 2 - PRODUCTS
We make reasonable efforts to provide accurate product descriptions, photographs, dimensions, materials, finishes, specifications, prices, and availability.
Actual colors and appearance may vary because of screen settings, photography, lighting conditions, natural material variations, handmade production, or reasonable manufacturing tolerances.
Natural stone, glass, crystal, wood, ceramic, and metal finishes may contain variations in color, texture, pattern, veining, bubbles, or surface details. These variations are not necessarily product defects.
Please review product dimensions, weight, voltage, wattage, bulb requirements, mounting requirements, installation conditions, and included components before ordering.

SECTION 3 - ORDERS AND CANCELLATIONS
Placing an order constitutes an offer to purchase. Everlamps Inc may accept, decline, correct, or cancel an order for legitimate reasons, including payment issues, inventory discrepancies, unsupported delivery addresses, clear pricing errors, or suspected fraud.
Cancellation or modification requests must be submitted before order processing, production, customization, or shipment preparation begins. Once any of these activities has started, cancellation or modification may no longer be possible.
Custom-made, modified, personalized, or made-to-order products cannot be canceled after production has started.
Orders that have already shipped cannot be canceled and must follow our Refund Policy.

SECTION 4 - PRICES AND BILLING
Prices, discounts, and promotions are subject to change without notice. The price charged will be the price displayed when the order is submitted, subject to correction of clear pricing errors.
Unless expressly stated otherwise, displayed product prices do not include shipping charges or applicable sales taxes.
Shipping charges and applicable sales taxes are calculated and displayed during checkout before payment is completed.
Everlamps does not represent that all orders include international duties or customs charges.
You represent that you are authorized to use the payment method submitted with your order.

SECTION 5 - SHIPPING AND DELIVERY
Processing and delivery timeframes are estimates and are not guaranteed delivery dates.
Delays may occur because of carrier operations, weather, transportation interruptions, seasonal shipping volume, delivery appointments, or other circumstances beyond our reasonable control.
Everlamps Inc will review and coordinate with the carrier when a shipment is confirmed lost in transit, materially damaged before confirmed delivery, incomplete, or delivered incorrectly.
For an approved claim, Everlamps will provide an appropriate resolution at no additional cost to the customer. Depending on the circumstances, the resolution may include free replacement parts, a replacement fixture, an approved return at our expense, a refund, or another reasonable solution.
Customers are responsible for providing complete and accurate shipping information, responding to carrier communications, arranging required appointments, and ensuring that the delivery location is accessible.

SECTION 6 - INSTALLATION AND PRODUCT USE
Hardwired lighting fixtures should be installed by a qualified electrician in accordance with local electrical codes, structural requirements, and installation instructions.
Customers and installers are responsible for confirming dimensions, weight, voltage, wattage, structural support, mounting conditions, bulb compatibility, dimmer compatibility, and installation clearances.
Damage caused by improper installation, unsuitable structural support, incorrect voltage, unauthorized modification, incompatible components, or failure to follow instructions is not considered a product defect.

SECTION 7 - RETURNS AND REFUNDS
Returns, refunds, return shipping costs, non-returnable products, damaged-product claims, and refund processing are governed by our Refund Policy.
Product returns require prior authorization. The Everlamps corporate and correspondence address does not accept product returns.

SECTION 8 - INTELLECTUAL PROPERTY
Website content, including text, original product descriptions, graphics, logos, layouts, photographs, videos, and other materials owned by, licensed to, or lawfully used by Everlamps Inc, is protected by applicable intellectual property laws.
Third-party trademarks and materials remain the property of their respective owners.
You may not reproduce, distribute, modify, republish, sell, scrape, or commercially exploit protected content without prior written authorization from the applicable rights holder.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
Everlamps is powered by Shopify, which provides the ecommerce platform used to operate our online store. Purchases made through our Store are transactions directly between the customer and Everlamps Inc.
Shopify is not the seller of Everlamps products and is not responsible for order fulfillment, product installation, product support, returns, refunds, or product-related claims.
Your use of Shopify-operated features may also be subject to Shopify’s applicable terms and privacy notices.

SECTION 10 - PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Certain personal information may also be processed in accordance with Shopify’s applicable privacy policies.
Information may be shared with payment processors, shipping carriers, fulfillment providers, fraud-prevention providers, customer support providers, and other service providers as necessary to process transactions and operate the Services.

SECTION 11 - THIRD-PARTY TOOLS AND LINKS
The Services may provide access to tools, applications, integrations, or websites operated by third parties that we do not control.
Your use of third-party services is subject to the applicable provider’s terms and policies.
Everlamps Inc is not responsible for the independent content, availability, privacy practices, security, or business practices of third-party websites or services.

SECTION 12 - FEEDBACK
If you submit reviews, photographs, comments, suggestions, or other content, you represent that you have the right to provide that content.
You grant Everlamps Inc a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, display, and distribute submitted content for operating, improving, and promoting the Services.
Submitted content must not infringe intellectual property, privacy, publicity, or other legal rights.

SECTION 13 - ERRORS AND INACCURACIES
The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to descriptions, prices, promotions, availability, shipping, or other information.
We may correct errors, update information, or cancel an affected order when reasonably necessary.

SECTION 14 - PROHIBITED USES
You may not use the Services to violate applicable laws; infringe intellectual property, privacy, or other legal rights; transmit harmful code; submit fraudulent information; interfere with website security; collect personal information without authorization; send spam; or disrupt the Services.
We may restrict or terminate access when we reasonably believe these Terms have been violated.

SECTION 15 - DISCLAIMER OF WARRANTIES
We make reasonable efforts to maintain accurate website information, but we do not guarantee that all content will always be complete, current, uninterrupted, secure, or error-free.
To the fullest extent permitted by applicable law, the Services are provided on an “as available” basis.
Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded.

SECTION 16 - LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Everlamps Inc will not be liable for indirect, incidental, special, punitive, or consequential losses arising from improper product installation, unauthorized modification, improper use, or unauthorized use of the website.
This limitation does not exclude liability that cannot legally be excluded and does not override remedies stated in our Shipping Policy or Refund Policy for approved returns, confirmed transit loss, transportation damage, defective products, missing components, or incorrect products.

SECTION 17 - INDEMNIFICATION
To the extent permitted by law, you agree to indemnify Everlamps Inc against third-party claims arising from your unlawful use of the Services, material violation of these Terms, or infringement of another person’s rights.

SECTION 18 - SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed where necessary. The remaining provisions will continue in effect.

SECTION 19 - TERMINATION
We may suspend or terminate access to the Services when a user materially violates these Terms, threatens website security, engages in fraud, or uses the Services unlawfully.
Provisions that should reasonably continue after termination will remain effective.

SECTION 20 - GOVERNING LAW
These Terms and any separate agreements through which Everlamps Inc provides products or services shall be governed by and construed in accordance with the laws of the State of California and applicable federal laws of the United States, without regard to conflict-of-law principles.
Any dispute shall be handled in an appropriate state or federal court located in California, except where mandatory consumer protection laws or other applicable laws require a different jurisdiction or venue.

SECTION 21 - CHANGES TO THESE TERMS
We may update these Terms to reflect operational, legal, regulatory, product, or service-related changes.
The updated version will be published on this page and will become effective as permitted by applicable law.
